Alleged Ponzi Schemer’s Ex-Wife Can Keep (Possibly) Ill-Gotten Cash, Court Says

Paging Ruth Madoff! Looks like one judge ruled that a Ponzi-wife can keep her husband’s allegedly ill-gotten cash. Of course, it helps that this particular couple divorced in 2007.
Janet Schaberg is the former wife of WG Trading exec Stephen Walsh, who’s currently facing charges that he defrauded investors to the tune of $550 million during an alleged 13-year Ponzi scheme, according to Dealbook. Of course, Schaberg claimed she didn’t know anything about the purportedly ill-gotten cash… but that didn’t stop authorities from freezing almost all of her assets (which included $7.6 million in cash) in August 2009. Ouch.
But the New York State Court of Appeals ordered yesterday that “New York’s concern for finality in business transactions” barred it from stripping Schaberg of her (possibly tainted) divorce dough — regardless of the fact that her ex-husband is still fending off fraud claims.
